Knee injury compensation after a fall in the workplace

When a client fell in the workplace our personal injury solicitors acted swiftly to secure a £6,825 settlement compensation.

In this case, our client tripped over a piece of corrugated mesh fencing left on the ground and difficult to see. He claimed the mesh fencing was left behind by builders who had been working on the premises.

Knee injury at work claim

Our client suffered an injury to his knee which required him to have intensive physiotherapy and rehabilitation after the accident.

The site of the incident was around a school grounds where our client was working at the time.

He attended the Royal Oldham Hospital for treatment where an X-ray showed some tissue damage to the right knee.  For weeks after the incident he could not put pressure on this leg, neither was he able to weight bear.

Employers liability insurance

Employers have a duty of care to their employees and must provide a safe working environment are required by law to have employer liability insurance, so normally their insurance company will pay out damages due.

In some cases the employer can be strictly liable by law for an injury in the workplace. In other circumstances, it may be necessary to show where negligence has taken place.

Commenting on the case, Solicitor and head of Personal Injury, Michael Talbot, said:

Accidents at work can be commonplace, we do not expect to be injured when we turn up for work but sadly there always a risk and employers should be aware that they need to provide a safe place to work and regularly check their premises.”
