Food Poisoning claim that ruined a Family Holiday

A family meal out in Oldham led to a severe case of food poisoning and ruined a family holiday for our client, but fortunately, the Personal Injury lawyers at Pearson Solicitors secured a £26,500 settlement to compensate the family for the inconvenience, pain and suffering.

Food Poisoning from a Chicken Burger

Our 33-year-old client contracted food poisoning from a buttermilk chicken burger at the Bridgewater Hotel public house on Manchester Road, Oldham.

Within hours of eating the chicken burger, she was ill with fever, severe abdominal cramps, sickness, and diarrhoea, she was also left with long lasting fatigue as well as impaired concentration.  After contacting a doctor and giving a sample she was diagnosed with campylobacter gastrointestinal tract infection (a type of bacterial food poisoning).  Once this was confirmed Public Health England had to be informed.

A claim was made against Joseph Holt Limited, owners of the Bridgewater Hotel pub and an out of court settlement was reached with our client.

Our client had three courses of antibiotics to get over the infection but was been left weakened and with continued fatigue and anxiety. The expert medical opinion also stated that she had been psychologically affected by the incident and had been unable to undertake her normal duties in the classroom at work.  She has also suffered from continued irritable bowel syndrome.

A report by the Food Standards Agency (FSA) has stated that an estimated 2.4 million cases of foodborne illness occur every year in the UK. Of these approximately 16,300 receive hospital treatment with over 180 reported deaths.

The Settlement

As part of the settlement made, an account was taken of the support and assistance she has needed since the incident over a course of months from her husband and family.  The costs of prescription, driving duties and mileage also formed part of the settlement.

“It is not uncommon in cases like this for family members to help with care and recuperation, but this assistance should not be overlooked and taken for granted, there is a cost associated to it and it does form part of the special damages awarded,” said Personal Injury solicitor Michael Talbot.

“In this case after the meal our client headed off for a family holiday hoping to get better, however the whole week was ruined and so again this is taken into account in the damages awarded,” he added.
