Accident on the Manchester Metrolink Tram

A client who was thrown from her seat and injured on a Metrolink tram has been awarded £2,200.00 in compensation. Our Personal Injury lawyers investigated her case.

Public Transport Accident Claim

Our client, a woman in her 30’s was returning home to Oldham from Manchester with her partner and daughter when the incident occurred.  She was flung from her seat when the driver performed an emergency braking procedure.

She landed on the floor of the vehicle and three other adults landed on top of her injuring her arm, shoulder and neck.  She has also sustained psychological symptoms as a result of the accident.

“This accident has had a severe effect on my client for over 12 months,” said Personal Injury lawyer, Lisa Anderson.  “She has been in pain and unable to sleep.  Due to the pain of her injuries, she has also not been able to pursue her hobbies of going to the gym and swimming, has been nervous and suffered from anxiety.

“In addition, she has developed a fear of the tram system and is nervous to travel, only able to sit at the rear of the vehicle.

“Hopefully the personal injury settlement achieved will help with any care or physiotherapy she needs, as well as compensating her for the pain and suffering caused,” added Lisa.

Public Transport Negligence

As part of the case, it was alleged that the defendant, Keolis Amey Metrolink Ltd were negligent in that their driver did not advise passengers of the sudden breaking, failed to give adequate warnings, failed to control the tram to avoid excessive breaking and did not drive with reasonable care and attention, thus exposing passengers to foreseeable and unnecessary injury.

Liability was denied by the Defendant throughout the whole claims process which forced the claim to be litigated. The matter finally settled on the day of trial for a sum which reflected the risk to the Claimant of a negative outcome if the trial went ahead.
